What we cover in the consultation

A structured session that maps your consumer complaint from grievance to compensation — covering forum selection, evidence, and realistic outcomes.

Forum Selection

Identify the right forum — District CDRC (up to ₹50 lakh), State CDRC (₹50 lakh–₹2 crore), or National CDRC (above ₹2 crore) — based on your claim amount and the nature of the deficiency.

Compensation Assessment

Understand the full scope of compensation you can claim — refund, replacement, repair, compensation for mental agony, and litigation costs. Many consumers under-claim significantly.

Evidence Strategy

Learn exactly what documents to gather — purchase receipts, warranty cards, correspondence, expert reports — and how to present your case to maximise the chances of a favourable order.

Grievance Redressal First

Assess whether the company's internal grievance mechanism or the National Consumer Helpline (1800-11-4000) should be attempted first — often faster than forum proceedings for straightforward deficiencies.

The Consumer Forum Process

A structured forum process designed to be faster and cheaper than civil courts — with time limits that courts must follow.

01

Send Complaint to Company

Before filing, send a written complaint to the company's grievance officer. This creates a record, satisfies the "opportunity to remedy" requirement, and sometimes resolves the matter without forum proceedings.

02

File Complaint at CDRC

File a written complaint at the appropriate Consumer Disputes Redressal Commission — District, State, or National — with all supporting documents and a nominal filing fee (₹50–₹5,000 depending on claim amount).

03

Admission & Notice to Opposite Party

The forum admits the complaint (or rejects it if not maintainable) and sends notice to the company. The company has 30 days to file a written statement in response.

04

Hearing & Arguments

Both parties present their case. The forum may call for additional documents, expert opinions, or mediation. Most straightforward cases resolve within 90–150 days of filing.

05

Order & Execution

The forum passes an order — directing refund, replacement, repair, or compensation. If the company fails to comply within 30 days, execution proceedings can be initiated.

Legal Framework

India's consumer protection framework is one of the strongest in Asia — covering products, services, e-commerce, and unfair trade practices.

Primary Law

Consumer Protection Act, 2019

The primary statute governing consumer rights — covering product liability, service deficiency, unfair trade practices, and e-commerce transactions.

E-Commerce

Consumer Protection (E-Commerce) Rules, 2020

Specific rules governing online marketplace liability, return policies, seller identification, and grievance officer requirements for e-commerce platforms.

Product Safety

Consumer Protection (Product Liability) Rules, 2020

Establishes manufacturer, seller, and service provider liability for defective products causing harm — enabling compensation claims beyond mere refund.

Mediation

Consumer Protection (Mediation) Regulations, 2020

Forums can refer disputes to mediation at any stage — providing a faster resolution path for matters where both parties are open to settlement.

Client Success Stories

My builder delayed possession by 3 years. I had no idea I could claim compensation for mental agony in addition to the delay penalty. The consultation opened my eyes — I filed at the State CDRC and received ₹4.2 lakh in total.

Frequently Asked Questions

The forum depends on the value of your claim: District CDRC handles claims up to ₹50 lakh, State CDRC handles ₹50 lakh to ₹2 crore, and the National CDRC handles claims above ₹2 crore. For most consumer disputes, the District CDRC is the starting point.
Yes. A consumer complaint must be filed within 2 years from the date the cause of action arises — typically the date of purchase, date of service failure, or date the company finally refused your grievance. Delayed complaints can be condoned if there is sufficient cause.
Yes. Under the Consumer Protection Act 2019 and the E-Commerce Rules 2020, marketplace platforms have specific obligations and can be made a party to complaints involving sellers on their platform — particularly where the platform was involved in the transaction or failed its duties.
Beyond a refund or replacement, you can claim compensation for mental agony and harassment, loss of time, medical expenses caused by a defective product, and litigation costs. Courts have awarded substantial compensation in cases involving significant distress.
