Government stamp duty charges apply to registered documents and vary by state. These are paid directly to the government and are not part of our service fee. Your advocate will confirm the applicable amount for your state before any document is executed.
Non-patentable subject matter includes: mathematical methods, business methods, abstract algorithms, discoveries of natural phenomena, traditional knowledge, and plants or animals. Pharmaceutical patents on known molecules are also restricted under Section 3(d) unless enhanced efficacy is demonstrated.
A provisional application is filed when the invention is not yet complete — it secures a priority date and gives the inventor 12 months to file the complete specification. A complete application includes full claims and description and is necessary for the patent to be examined and granted.
Patent examination and grant in India typically takes 3–5 years from the date of filing. Expedited examination is available for startups, MSMEs, government entities, and certain applicant categories — this can reduce the timeline to 1–2 years.
An Indian patent only protects the invention in India. For global protection, you must file in each country or use the PCT route, which allows a single international application to seek protection in 150+ countries. The PCT filing must be done within 12 months of the Indian priority date.
