The process typically takes 18–24 months from filing to registration. However, protection is deemed to exist from the date of filing — not the date of registration — so your rights are established immediately upon application.
The TM symbol can be used from the date of application — it signals your claim to the mark. The ® symbol can only be used after the trademark is officially registered by the Registry. Improper use of ® before registration is a punishable offence.
Common English words are generally not registrable as they lack distinctiveness. However, invented words, coined terms, and distinctive combinations of common words can be registered. The Examiner assesses distinctiveness and may raise objections for common words.
After publication in the Trademark Journal, a third party has 4 months to file an opposition. We file a counter-statement on your behalf and represent you through the opposition proceedings — which can include evidence rounds and a hearing before the Registrar.
