Stamp Duty Not Included

Government stamp duty charges apply to registered documents and vary by state. These are paid directly to the government and are not part of our service fee. Your advocate will confirm the applicable amount for your state before any document is executed.

The renewal application can be filed up to 6 months before the expiry date (without surcharge) or within 6 months after expiry (with a surcharge). Applying at least 3–6 months before expiry is strongly recommended to avoid any gap in protection.
If renewal is not filed within 6 months of expiry, the trademark is removed from the Register by the Registrar. A removed mark can be restored within one year of removal by filing a Restoration application (TM-R with restoration request) and paying restoration fees.
No — the trademark must first be formally assigned from the previous owner to the new owner through a registered trademark assignment. Only after the assignment is recorded can the new owner renew in their name.
It depends on commercial strategy. Unused trademarks can be challenged for non-use (5+ years of non-use). However, if the mark has brand recognition or future value, renewal and recommencement of use is advisable. Our IP team can advise on portfolio strategy.
